Patchnet SMS Terms of Use & Privacy

1. Introduction & Agreement

These SMS Terms of Use and Privacy Policy (“SMS Terms”) govern the text messaging service operated by Patchnet, Inc. (“Patchnet,” “we,” “us,” or “our”).
By opting in or engaging with the SMS service, you agree to these SMS Terms in addition to our General Privacy Policy.

2. Definitions

  • Opt-In: Your affirmative consent to receive SMS messages from us (via form, checkbox, or texting a keyword).

  • Service: One-to-one or transactional SMS exchanges related to Patchnet services.

  • Subscriber / You / User: The individual who opts in to receive SMS from Patchnet.

3. Consent, Scope & Message Types

By opting in, you authorize Patchnet to send you:

  • Operational / transactional messages (appointment reminders, updates, replies to your inquiries)

  • Conversational responses based on your messages

  • Notifications relevant to the services you use with Patchnet

Marketing messages will only be sent if you have explicitly opted in to receive such messages.

4. Message Frequency & Costs

  • Message frequency varies depending on your interaction with us.

  • Message & data rates may apply from your mobile carrier.

  • You are responsible for any charges from your carrier for sending or receiving SMS messages.

5. HELP, STOP & Opt-Out

  • HELP: You may reply with the keyword HELP to get more support.

  • STOP / Unsubscribe: You may reply with STOP (or alternative keywords like QUIT, END, CANCEL, UNSUBSCRIBE) to opt out. You’ll receive a confirmation message and no further SMS will be sent.

Example HELP reply:

“Patchnet: For help, email support@patchnet.net or call (305) 499-4999. Msg & data rates may apply. Reply STOP to unsubscribe.”

Example STOP confirmation:

“You have successfully unsubscribed from Patchnet SMS alerts. No further messages will be sent.”

If you change carriers or phone numbers, you might need to opt in again.

6. Privacy: What We Collect & How We Use It

We may collect:

  • Your mobile number, carrier, message content you send, delivery status, timestamps, and technical metadata (device, IP)

  • Usage metrics for analytics, debugging, and service improvements

We use this information to:

  • Deliver and support the SMS service

  • Respond to your inquiries and manage preferences

  • Improve quality, maintain security, and prevent fraud

We will not sell, rent, or transfer your mobile number or SMS opt-in information to third-party marketers or advertisers.

We may share limited information with service providers (e.g., messaging platforms, hosting) strictly for purposes of delivering the SMS service, subject to contractual safeguards. We may also disclose information when required by law or to protect rights, safety, or security.

7. Data Retention & Security

  • We retain opt-in records, message logs, and opt-out confirmations for at least 3 years (or whatever period you set).

  • When data is no longer needed, we will securely delete or anonymize it.

  • We implement reasonable administrative, technical, and physical safeguards to protect data against unauthorized access or alteration.

8. Liability, Disclaimers & Use Limitations

  • The SMS service is provided “as is,” without warranties (express or implied).

  • Patchnet is not liable for indirect, incidental, special, or consequential damages arising from use of (or inability to use) the SMS service.

  • We are not responsible for delays, failures, or errors in message delivery caused by carriers, network issues, devices, or other external factors.

  • You agree not to use the SMS service for unlawful, abusive, harassing, defamatory, or otherwise prohibited content. You must comply with applicable laws and carrier policies.

9. Changes & Updates

We may change or update these SMS Terms from time to time. If changes are material, we will attempt to notify you (e.g. via SMS or on this site). Continued use after changes indicates acceptance of the new terms.
